Sep 27 2009, 01:54 AMLast 3 years, I conducted a legal research on decliminalisation of using of check. I have learnt that using of bad check is criminalized in many countries while many countries are not. In the United States, only 33 states sentence people using of bad check to jail. Some conties such as France, to be punished, you got to prove that payment was conducted in bad faith or fraud.
Though finacial people supported me in using monetary instrument instead of criminal law to control of those bounced check but I failed to propose the law to decrimialized using of bad check. Thai lawyers didn't agree with this.
I wonder if our comminity could share this regard. I will be standing up and fight for the issue again since sentencing to jail just because of not able to pay dept is not fair, I believe.

Feb 02 2010, 09:42 AMI agree with your opinion Mr. Pongpat Riangkruar, It is really bad criminalizing the bad check in all the cases. There is no point in sending the people using bad check to Jail. Even the people who have not acted fraudulently would be punished under such law. I think, every country shall follow the system of France, where the plaintiff needs to prove that the payment was conducted in bad faith or fraud.
I request the members of this community to have talk on this and come to conclusion of the criminalization of the using of bad check.
