Value of digital discovery

Apr 23 2009, 04:07 PMIt depends on the type of case, but in more and more cases the issue is beyond cost-benefit analysis. It's a necessity. The bulk of discoverable information now exists electronically. Not pursuing electronically stored information (ESI) may amount to malpractice in many areas of law. In those areas then, the cost of not pursuing ESI will likely be loss of case and may be loss of license to practice law.
